TERMS & CONDITIONS

Eligibility

This ‘MISTER POTATO CASH SPLASH CONTEST’ ("Contest") is organized by Mamee-Double Decker (M) Berhad ("MDD") and is open to all Malaysian citizens and residents aged 18 years or older as of 1^st January 2012 in possession of a valid Malaysian Identification Card.

The following group of persons shall not be eligible to participate in this Contest:

Employees of MDD (including its affiliated and related companies) and their immediate family members, representatives, employees, servants and/or agents of advertising and/or promotion service providers of MDD (including its affiliated and related companies) and their immediate family members and/or MDD’s elected printing vendors and also their elected SMS technology provider (including their immediate family members).

Duration

This Contest shall run from 0:00:00 AM on 1st June 2012 to 23:59:59 PM on 31^st July 2012 ("Contest Period"). MDD reserves the right to amend the Contest Period at any time without any notice. All entries received outside the Contest Period shall not be entertained.

Submission of Entries / How to participate

1. To participate in this Contest, participants are required to purchase any contest edition Mister Potato Rice Crisps 130g canisters to obtain the SMS code provided on canister foil lid.

2. Participants are required to answer a simple question as stated on the promotional sticker on the canister only in English.

3. Participants are required to submit the SMS code and answer via SMS as stated on the packaging instructions.

The following is an example of a submission of entry via SMS*:

ii. The SMS entries are to be sent to 36660.

*The Contestant will only be charged standard SMS fees by the Contestant’s mobile phone operator.

4. Each SMS code provided is valid only for one (1) entry and the CANISTER FOIL LID is to be retained as a PROOF OF PURCHASE in the event that the participant is declared a winner by MDD.

5. MDD reserves the right to disqualify Contestants should they fail to provide the necessary proof of purchase during prize collection.

6. Exciting prizes await contestants who submit the most number of entries with the correct answers.

Prizes

1. Daily Prizes

a. There will be a total of 305 Daily Prizes worth RM 100 each.

b. 5 Winners will be chosen daily throughout the contest period.

c. The participant with the highest number of correct entries of the day will win the Daily Prize.

d. The winning criteria shall be based on the MOST NUMBER SMS ENTRIES WITH THE CORRECT ANSWERS sent throughout the day by the contestant.

e. Daily Prize winners are only entitled to win one Daily Prize throughout the contest period.

f. Should there be a tie, the participant who sends the highest number of SMS entries for the day whose last SMS entry reaches the earliest will be determined the winner.

Qualifying Criteria (Rules & regulations)

1. Registration is only open to Malaysian citizens and residents above 18 years of age as of 1^st January 2012 with a valid Malaysian Identification Card.

2. Submission of entries for this Contest must be done via SMS. Incomplete SMS entries shall be disqualified automatically without any notification.

3. Each SMS entry sent will be subject to normal SMS charges by the respective service providers and all costs shall be borne by each participant. Participants who choose to enter the contest need to possess their own registered hand phone or mobile device number with a valid service provider which includes an SMS service.

4. Each entry received during the Contest Period shall be documented according to the time of receipt (yy/mm/dd/hh/mm/ss/). The time of receipt shall be used to determine the Daily winner(s).

5. All SMS entries must be received by MDD by 23:59:59 at the end of the day during the Contest Period. All entries received after the closing deadline will not be considered.

6. MDD has the absolute discretion to reject or disqualify an entry without giving any reason whatsoever to any participants or any other party.

7. Participants are not encouraged to use more than one mobile number to submit their entries.

8. MDD reserves the right to withdraw the prizes in the event that the winners do not comply with the contest rules and regulations.

9. Winners shall be notified via phone, SMS or any other means of communication deemed fit by MDD after the contest end date based on the particulars provided to MDD during the SMS registration process. MDD shall not be held liable in the event that the winner(s) cannot be contacted for whatever reasons. MDD shall not be held liable in the event of non-receipt or delayed delivery of any notification to the winner(s).

10. Details of each Winner shall be published on www.misterpotato.com.my ("Website") 3 to 5 working days after the end of the contest duration. Participants are advised to check the Website constantly. MDD will not be held responsible for any failure, technical glitch or delay in the winners’ announcement.

11. ALL prizes will only be given out within THREE (3) months after the contest end date.

12. MDD is entitled to change or replace any of the offered prizes with any prize of equivalent value at any time without giving any prior notice to the participants. The values of the prizes are correct at the time of publication.

13. As entries are transmitted over the networks of independent telecommunication providers over which MDD has no control, MDD shall not be responsible for any failure or delay in the transmission of the SMS entry which may result in the contestant/participants being omitted from the selection process during the Contest Period.

14. MDD shall not be liable in any way with regards to the quality and the suitability of the offered prizes.

15. All prizes must be claimed from MDD (in Peninsular Malaysia or East Malaysia) by the Winners personally within FOUR (4) months after the Contest end date. Any unclaimed prize shall be withdrawn by MDD and the Winner(s) shall no longer be entitled to claim any prize in any form.

16. Contest Winners shall bear all costs of calls and transportations to the office of MDD to claim for the respective prize(s).

17. MDD shall not be held responsible should any of the prizes suffer any lost or damages during delivery to the Winner(s).

18. Prizes are not transferable and cannot be converted into any other form.

19. When claiming the prize, the following conditions are to be followed; the winner is required to present themselves and show the MDD officer his/her original valid Malaysian Identification Card and registered mobile device number for verification, which must be legible. MDD is entitled to reject the winner’s claim to the prize if the participant does not agree to this condition.

20. By participating in this contest, Winners hereby grant MDD the right to broadcast the names, pictures or display any matter related to any of the Winners for advertising purposes and publicity related to the Contest without any further notice to the Winners. The Winners are not entitled to claim any payment in any form, fee or compensation for the use of their images or details in relation to the above.

21. All Winners must attend the prize presentation ceremony and/or any other general activities for the purpose of promoting and advertising this Contest if being requested by MDD. Any participant who fails to comply with the terms and condition of this Contest shall automatically be disqualified.

22. The judge’s decision in respect to this Contest or any part thereof shall be final and binding and no correspondence (verbal or written) shall be entertained.

23. By participating in this Contest, all contestants are fully aware and agree to be liable to all the terms, conditions and decisions made by MDD. All decisions made with regards to this Contest are final and no correspondence thereon shall be entertained.

No Warranty

MDD and its subsidiaries, officers, directors, employees, agents, suppliers and/or subcontractors provide this service on a "as is" basis and without any warranty or condition, whether express or implied. MDD and its subsidiaries, officers, directors, employees, agents, suppliers and/or subcontractors specifically disclaim the implied warranties of title, merchantability, performance, fitness for a particular purpose and non-infringement. In addition, no advice or information obtained (whether orally or written) by the participants from MDD shall create any warranty.

Limitation of Liability

MDD reserves the right to change, amend, insert and/or suspend any of the terms or conditions stated herein without prior notice to the participants. MDD does not guarantee service availability and shall not be held liable for any delay or failure in performance in any event. The use of this text messaging service is at the participants’ sole risk, and MDD disclaims all liability for any damage that may be caused to the participants’ equipment (mobile phones, handheld devices, computer hardware, software and data inclusive) due to the use of this SMS service and website.

In no event shall MDD or its subsidiaries, officers, directors, employees, agents, suppliers and/or subcontractors be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential and/or incidental, arising out of or relating to the participant’s conduct or anyone else in connection with the use of this SMS service or website, the service or these terms and conditions, including but without limitation to lost profits or any special, incidental or consequential damages (however arising, including negligence) arising out of or in connection with these terms and conditions.

Indemnification

The participants hereby undertake to MDD that they shall indemnify and keep MDD indemnified from and against all claims, damages, liabilities, deficiencies, penalties, losses, costs, expenses (including without limitation, legal fees and disbursements on a full indemnity basis) which MDD may suffer, incur or sustain as a result of or in consequence of or in relation to any breaches of any of the representations, warranties, undertakings and terms contained in these terms and conditions of use.

Severability

If any provision of these terms and conditions are held unenforceable, then such provision shall be modified to reflect MDD's intention. All remaining provisions of these terms and conditions shall remain in full force and effect.

Variation

MDD reserves the right to modify or terminate the Contest for any reason, without notice, at any time. MDD also reserves the right to alter the provisions of these terms and conditions regarding the Contest at any time without further notification to the participants.

Additional:

MDD’s decision on all matters relating to this Contest shall be final, conclusive and binding. MDD shall not be obliged to give any reasons or enter into any correspondence with any person(s) on any matter concerning the Contest.

MDD shall not be responsible nor shall accept any liabilities of whatsoever nature and however arising or suffered by the partipants and/or third parties resulting directly or indirectly from the Contest and/or the Prizes.

In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Contest, these terms and conditions shall prevail.

In the event of a discrepancy or conflict between the English and Bahasa Malaysia versions of these terms and conditions, the English version shall prevail.
